1. Warrantor and Eligibility
This limited warranty (“Warranty”) is provided by Surplex, Co. (“Surplex”) for Striv-branded smart insoles, sensing inserts, processing pods, batteries, chargers, and other hardware sold as part of a Striv consumer product package (the “Product”). Striv is a Surplex brand, not a separate legal entity.
This Warranty applies to the original retail purchaser, or a gift recipient who has reasonable proof of the original purchase, when the Product was purchased directly from Surplex or an authorized Surplex seller. It applies to consumer use, not resale or unauthorized commercial, clinical, or research use.
This Warranty covers hardware only. Software, firmware, AI outputs, subscriptions, and digital services are governed by the Terms of Service.
2. Warranty Period
The Warranty lasts for one year from the date the Product is delivered to the original purchaser. If reliable delivery records are unavailable, the period begins on the purchase date shown on reasonable proof of purchase.
3. What Is Covered
Surplex warrants that, under normal intended consumer use and during the Warranty Period, the Product will be free from defects in materials and workmanship. Covered defects may include:
- sensor, processing, charging, or connectivity hardware failures caused by a manufacturing defect;
- premature component failure under normal use that is not ordinary wear; and
- a rechargeable battery or charging component that fails because of a defect, excluding normal reduction in battery capacity over time.
This Warranty does not promise uninterrupted operation, clinical-grade accuracy, compatibility with every shoe or third-party device, or any particular fitness, athletic, or health result.
4. What Surplex Will Do
If Surplex confirms a covered defect during the Warranty Period, Surplex will, at its option and without charge for covered parts and labor:
- repair the defective Product; or
- replace it with a new or refurbished Product or component that is functionally equivalent.
If repair or replacement is not reasonably available after a reasonable opportunity to provide a remedy, Surplex may refund the amount paid for the defective Product upon its return. A repaired or replacement Product is covered for the longer of the remainder of the original Warranty Period or 90 days after delivery of the repaired or replacement Product.
5. What Is Not Covered
This Warranty does not cover:
- normal wear and tear, cosmetic changes, gradual loss of cushioning, expected sensor-insert wear, or normal reduction in rechargeable-battery capacity;
- damage caused by accident, abuse, misuse, excessive force, improper fit, improper storage, extreme temperature, fire, chemicals, animals, or other external causes;
- water or liquid damage caused by use beyond the Product's published water-resistance rating or contrary to the current User Manual;
- failure to follow the User Manual, charging, cleaning, care, installation, calibration, or safety instructions;
- damage caused by an incompatible or defective shoe, power source, charger, accessory, mobile device, network, or third-party product;
- damage caused by unauthorized modification, altered firmware, disassembly, or repair, except that Surplex will not deny coverage merely because a third party performed work unless that work or modification caused or contributed to the claimed defect;
- lost, stolen, or intentionally damaged Products; altered or removed serial numbers; or Products acquired from an unauthorized seller; or
- software errors, service interruptions, lost data, AI outputs, or issues that can be resolved through a software or firmware update without a hardware repair.
6. How to Make a Warranty Claim
- Stop using the Product if it appears damaged, unusually hot, swollen, leaking, or otherwise unsafe.
- Email info@striv.run with your name, order number, receipt or other reasonable proof of purchase, Product serial number if available, a description of the problem, and photos or diagnostic information reasonably requested by Surplex.
- Complete reasonable remote troubleshooting and follow the return instructions. Do not send a Product to our mailing address unless the instructions specifically direct you to do so.
Surplex may require return of the Product before providing a remedy. Any diagnostic request will be limited to information reasonably needed to evaluate the claim.
7. Warranty Shipping
For a claim approved for return under this Warranty, Surplex will provide a prepaid shipping label or reimburse reasonable authorized shipping costs and will pay to ship the repaired or replacement Product to you. You must pack the Product reasonably and follow the provided instructions.
If inspection shows that the issue is not covered, Surplex will explain the finding and obtain your approval before charging for any optional repair, replacement, or return shipping.
8. Disclaimers and Limitations
TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE ONE-YEAR WARRANTY PERIOD. SOME STATES OR COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU.
TO THE EXTENT PERMITTED BY LAW, SURPLEX IS NOT RESPONSIBLE UNDER THIS WARRANTY FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. SOME STATES OR COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
Nothing in this Warranty excludes or limits liability or remedies that cannot lawfully be excluded or limited, including applicable rights relating to personal injury, defective products, fraud, gross negligence, recalls, or mandatory consumer guarantees.
9. Your Legal Rights
This Warranty gives you specific legal rights, and you may also have other rights that vary from state to state or country to country. Consumers outside the United States may have mandatory legal guarantees in addition to this Warranty. Those rights are not replaced or reduced by this Warranty.
The Return Policy is separate from this Warranty. Returning a non-defective Product during the voluntary return window is governed by that Policy; a covered hardware defect is governed by this Warranty.
